AGREEMENT TO TERMS
This Terms and Conditions agreement (the "Agreement") sets forth the terms and conditions under which ChaletsAdvisor, a company registered in the United Kingdom and owned by TravelAdvice Ltd., offers the Services to its Tenant(s) or Guest(s) herein referred to as Customers. By using the Services, the Customer agrees to be bound by the Terms and Conditions of this Agreement.

The following definitions apply to this Agreement:
Services” - The Services provided by ChaletsAdvisor refer to the website that allows customers to view and book rental properties, such as apartments, villas, and chalets, listed on the website. ChaletsAdvisor website does not allow Customers to create, edit, or display listings on ChaletsAdvisor website. ChaletsAdvisor website only displays properties that have been personally inspected by ChaletsAdvisor staff.
Properties and Property Owners“ - The properties offered for rent through the Services are referred to as "Properties" and the owners of these properties are referred to as "Property Owners". Customers cannot create, edit, or delete listings on the ChaletsAdvisor website. To book a property, Customers make an inquiry to ChaletsAdvisor, and if the Property Owner confirms availability, ChaletsAdvisor will send an offer to the Customers. If the Customer agrees to the offer, ChaletsAdvisor will send a rental agreement, invoice, and payment information to complete the booking.
Tenant” or “Guest” or “Customers” refers to the individual(s) who rents a Property from the property owner through ChaletsAdvisor website.

1.USE OF SERVICES
Welcome to ChaletsAdvisor website (the "Website"). The website is offered by ChaletsAdvisor and provides a service to allow Customers (the “guest” or “tenants”) to search, view, and book luxury rental properties such as apartments, villas, chalets, etc. (the "Properties"). Any other use of the Services is expressly prohibited. The Customer shall not use ChaletsAdvisor website or use the rental properties in any manner that is illegal, fraudulent, or harmful to ChaletsAdvisor or its property owners. You agree that by accessing ChaletsAdvisor website, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING ChaletsAdvisor website AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on ChaletsAdvisor website from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use from time to time. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply. Accordingly, those persons who choose to access ChaletsAdvisor website from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. 3. CUSTOMER REPRESENTATIONS

The Customers agree not to engage in any activities that are prohibited by these Terms and Conditions or by law while using the Services. Such activities include, but are not limited to, the following:

  • Infringement of third-party intellectual property rights, including, but not limited to, copyrights, trademarks, trade secrets, patents, and any other proprietary rights.
  • Hacking or unauthorized access to the Services or any data or information stored on the Services.
  • Distribution of malicious software, including viruses, worms, Trojans, spyware, adware, and other harmful code.
  • Use of the Services for illegal or fraudulent purposes, including, but not limited to, money laundering, tax evasion, and any other illegal activities.
  • Use of the Services to transmit any content that is harmful, offensive, or otherwise inappropriate, including, but not limited to, hate speech, pornographic material, and any other content that is offensive or illegal.
  • Use of the Services to promote or support illegal or unethical activities, including, but not limited to, terrorism, hate groups, and any other illegal or unethical organizations.
  • Use of the Services to engage in any activity that is in violation of any applicable laws or regulations, including, but not limited to, antitrust laws, consumer protection laws, and data protection laws.
  • Use of the Services to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Use of the Services to distribute or post any content that is false, misleading, or defamatory, including, but not limited to, false or misleading advertising or fraudulent offers.
  • Use of the Services to create multiple user accounts or to use the Services in a manner that is designed to artificially inflate or manipulate the Services or any data or information stored on the Services.
  • Use of the Services to reverse engineer, decompile, or otherwise attempt to discover the source code of the Services or any data or information stored on the Services.
  • Use of the Services in a manner that is designed to overload or otherwise disrupt the normal functioning of the Services or any data or information stored on the Services.

ChaletsAdvisor reserves the right to terminate the Customers' use of the Services in the event of any prohibited activity. The Tenant agrees to cooperate with ChaletsAdvisor in any investigation of suspected prohibited activities.
The Customers agrees that ChaletsAdvisor may take any action that it deems necessary to prevent any prohibited activity, including, but not limited to, disclosing information about the Customer to law enforcement authorities, blocking access to the Services, and removing any content that is in violation of these Terms and Conditions.
The Tenant agrees that ChaletsAdvisor shall not be liable for any loss or damage arising from any prohibited activity, including, but not limited to, any loss of data, any loss of income, or any other damages. The Customer shall be solely responsible for any costs or expenses incurred in connection with any prohibited activity.

5. PAYMENT
ChaletsAdvisor accepts payment only through bank transfer and in some cases we may accept payment through Credit Card. There is no booking fee, subscription fee, or transaction fee.

6. GUIDELINES FOR REVIEWS
We may provide you with areas on ChaletsAdvisor website to leave reviews or ratings. When posting a review, you must comply with the following criteria:
(1) you should have firsthand experience with the rental property being reviewed;
(2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language;
(3) your reviews should focus on the property and its amenities;
(4) your review should be concise and to the point, providing enough detail to be helpful to future guests, but not too lengthy that it becomes overwhelming;
(5) you should not be affiliated with competitors if posting negative reviews;
(6) you should not make any conclusions as to the legality of conduct;
(7) you may not post any false or misleading statements; and
(8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.

By following these guidelines, you can help ensure that the reviews on ChaletsAdvisor are trustworthy, helpful and relevant to the purpose of ChaletsAdvisor website. We may accept, reject, or remove reviews at our sole discretion.

7. SUBMISSIONS
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding ChaletsAdvisor website ("Submissions") provided by you to us are non-confidential and shall become our sole property. We reserve the right, but not the obligation, to
(1) monitor ChaletsAdvisor website for violations of these Terms of Use;
(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities;
(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;
(4) in our sole discretion and without limitation, notice, or liability, to remove from ChaletsAdvisor website or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and
(5) otherwise manage ChaletsAdvisor website in a manner designed to protect our rights and property and to facilitate the proper functioning of ChaletsAdvisor website.

12. GOVERNING LAW
These conditions are governed by and interpreted following the laws of the United Kingdom, and the use of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law of your country of residence. ChaletsAdvisor and you both agree to submit to the non-exclusive jurisdiction of the courts of which means that you may make a claim to defend your consumer protection rights in regards to these Terms of Use in the United Kingdom, or in the EU country in which you reside.
We reserve the right to change, modify, or remove the contents of ChaletsAdvisor website at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of ChaletsAdvisor website without notice at any time. 13. DISPUTE RESOLUTION

Binding Arbitration
Any dispute arising from the relationships between the parties to this contract shall be determined by one arbitrator who will be chosen in accordance with the Arbitration and Internal Rules of the European Court of Arbitration being part of the European Centre of Arbitration having its seat in Strasbourg, and which are in force at the time the application for arbitration is filed, and of which adoption of this clause constitutes acceptance. The seat of arbitration shall be Ilford, United Kingdom. The language of the proceedings shall be English. Applicable rules of substantive law shall be the law of the United Kingdom.

Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law,
(a) no arbitration shall be joined with any other proceeding;
(b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class-action procedures; and
(c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions to Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

14. DISCLAIMER
ChaletsAdvisor website is provided on an "as is" and "as available" basis. The Customer acknowledges and agrees that ChaletsAdvisor does not own or manage Properties and does not act as a real estate agent. ChaletsAdvisor is a travel agent for its Customer. ChaletsAdvisor only provides a website that advertises Properties for rent and manage the booking and reservation of Properties. ChaletsAdvisor will take care of its customers during their stay in any of the properties that they choose to rent . We fully disclaim all warranties, express or implied, related to ChaletsAdvisor website and its use. The Customer is solely responsible for the accuracy, completeness, and legality of the information and content provided in its listings and for complying with all applicable laws, regulations, and industry standards. The Customer agree to indemnify and hold harmless ChaletsAdvisor from any and all claims, damages, liabilities, or expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation by the Customer of these Terms and Conditions.

15. LIMITATIONS OF LIABILITY
Under no circumstances shall we or our directors, employees, or agents be held responsible for any damages, whether direct, indirect, incidental, special, consequential, exemplary, or punitive, arising from the use of ChaletsAdvisor website. This includes, but is not limited to, lost profits, lost revenue, data loss, or any other losses. Our liability to you, regardless of the form of the claim, shall always be limited to the amount, if any, paid by you to us. Some state and international laws do not permit the exclusion or limitation of implied warranties or certain damages, in which case the above disclaimers or limitations may not apply to you, and you may have additional rights.

16. INDEMNIFICATION
The Customer agrees to indemnify, defend, and hold harmless ChaletsAdvisor, its directors, employees, agents, partners, and suppliers from any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) that arise from or relate to the Customer's use of the Services, violation of these Terms, or violation of any rights of another.
This indemnification obligation will survive the termination of these Terms and Customer's use of the Services.
In the event of any third-party claim arising from or in any way related to the Customer's use of the Services, ChaletsAdvisor may engage in negotiations with such third-party and may, at its sole discretion, settle such claim, and the Customer shall be liable for all damages, expenses, and costs (including reasonable attorneys' fees) incurred by ChaletsAdvisor in connection with such negotiations and settlement.
The Customer shall cooperate as fully as reasonably required in ChaletsAdvisor's defense of any claim. ChaletsAdvisor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the Customer and the Customer shall not in any event settle any matter without the written consent of ChaletsAdvisor.

17. SEVERABILITY
If any provision of the Terms and Conditions is found to be unenforceable or invalid, such provision shall be severed from the rest of the Terms and Conditions, which shall remain in full force and effect. The severance of any provision shall not affect the validity and enforceability of the remaining provisions. The parties agree to replace any unenforceable or invalid provision with a provision that is valid and enforceable and that comes closest to expressing the intention of the unenforceable or invalid provision.

18. USER DATA
We will maintain certain data that you transmit to ChaletsAdvisor website for the purpose of managing the performance of ChaletsAdvisor website, as well as data relating to your use of ChaletsAdvisor website. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using ChaletsAdvisor website. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

19. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting ChaletsAdvisor website, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on ChaletsAdvisor website, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO THE ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA ChaletsAdvisor website. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

20. MISCELLANEOUS
These Terms of Use and any policies or operating rules posted by us on ChaletsAdvisor website or in respect to ChaletsAdvisor website constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Use or use of ChaletsAdvisor website. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.

Covid-19 Cancellation Policy

If the place where the property is located enters lock-down or the country from where the customer is coming from enters lock-down or if the flights or other types of transportation are canceled as a force majeure due to war, pandemic, fire, earthquake or other disasters, the customer is entitled to a full refund.

24/7 Support

The property is all yours but you’re not on your own. If you’re in resort, our team are on hand 24/7, 365 days a year to make sure there’s a helping hand should you need it. So if you need to speak to someone, our team of trusted experts can help make sure your holiday runs smoothly from start to finish.

At the Property

– All of our properties are private, independent buildings with separate, personal entrances. There are no shared spaces, and no physical contact with other tenants is possible.
– All of our properties will be equipped with hand-sanitizers and cleaning disinfectant throughout the premises. Protection kits consisting of masks, travel-size hand-sanitizers, and antibacterial tissues will also be available.
– Professional cleaning and certified, eco-friendly sanitization and disinfection, using electrostatic sprayers will take place in-between all bookings.
– A rigorous daily cleaning procedure will be in place, with certified cleaning products, as well as daily disinfection of higher risk areas, emphasizing common, frequently used surfaces, such as doorknobs, keys, remote controls, and mattresses.
– Air-condition units will be undergoing antimicrobial cleaning on a regular basis.
– The swimming pools, outdoor spaces, and all facilities on the property are private and exclusively available to our guests. Daily maintenance of the pool and disinfection will be carried out by certified professionals.

Throughout the years, it has always been one of our distinguishing priorities to always be available for our guests during their stay. This year, more than ever, all ChaletsAdvisor Specialists and our Local Concierges will be supporting our guests, ready to handle any special request or attend to any of our guests’ concerns, at any time.

Health and Sanitation Protocol

We are monitoring the information that becomes available about Covid-19 and are closely adhering to guidance from the major official sources. An official health protocol is being currently drafted, aiming to mandate the new standards in travel within the current Covid-19 crisis, following the regulations of the World Travel and Tourism Council (WTTC).

From our end, we have already enhanced our standard cleaning processes, setting a rigorous sanitation protocol, which will be dynamically modified to include any additional measures suggested by the official guidelines and which we will be implementing for all of our property rentals.

It is our priority to make sure that our guests are happy and safe in a meticulously professionally sanitized environment, and that our staff is educated and effectively protected in the context of their work.
